The Committee considered the planning and related applications that had been submitted to the Council.

 

Resolved:-

 

(1)    The decisions of the Committee on the planning and related applications are set out in the attached schedule;

 

(2)    In respect of application A/21/92056/MAJOR, the Committee are minded to approve the application and grant planning permission for the proposed development, subject to the following:

 

·     the conditions specified in the reports and outlined below;

 

·     satisfactory completion of a Section 106 Agreement containing the following financial contributions and provisions:

 

-       Policy compliant affordable housing provision; and

-       Contributions towards open space and play provision.

 

Authority is delegated to the Assistant Director – Legal, Governance and Elections to enter into the said Agreement and to the Director - Place to issue the Decision Notice subject to the satisfactory completion of the above matters; or, if the Section 106 Agreement is not completed within six months of the date of this Committee, to refuse the application at their discretion.

 

 

 

 

 

 

(3)    In respect of application A/22/93937/FULL, erection of a single detached dormer dwelling, the Officers’ recommendation was to approve application. The Committee resolved to refuse the application for the following reason:-

 

  • The development proposed would result in the loss of a section of alley-gate railing, erected originally to reduce the risk of anti-social behaviour, thereby leaving open access to the rear of 5 and 7 Peacock Fold.  The development therefore isn’t designed to be safe, so that crime and disorder, and the fear of crime, do not undermine the quality of life or community cohesion, and neither is it designed to reduce the risk of crime and anti-social behaviour for local residents, contrary to paragraph 96 of the National Planning Policy Framework, Policy JP-P1 of the Places for Everyone Joint Development Plan and Policy CP10 of the Wigan Local Plan Core Strategy.

 

The motion to refuse the application was proposed by Councillor Gerrard for the reasons outlined above and seconded by Councillor Fish.

 

(Councillor Greensmith declared she did not have an open mind regarding this item, having objected previously to it, and therefore left the Members’ Seating Area for the duration of the item and did not take part in the debate or vote)

 

(4)    In respect of application A/24/97730/CU, change of use of ground floor from dental surgery (Class E) to 5 bedroom, 5 person HMO (Class C4) and retention of existing first floor and second floor accommodation (Class C3) including demolition of existing garage, the Officers’ recommendation was to approve application. The Committee resolved to refuse the application for the following reasons:-

 

  • The development proposed fails to provide any off-road vehicle parking in an area where there is limited parking available in the locality of the site.  The development would therefore not ensure that appropriate provision for the parking of vehicles is available to serve the development and as a consequence, would add to existing parking pressures in the area, leading to an unacceptable impacts on highway safety and operation, and an inappropriate form of  ...  view the full minutes text for item 20.
